14/08   UNIT 26 PRIDE HILL, SHREWSBURY

Consideration was given to a report of the Planning Services Manager in respect of the change of use from A1 (non food retail) to A4 (drinking establishment) at Unit 26 Pride Hill, Shrewsbury. The Committee had considered the application at their meeting held on 5th February 2008 and resolved to approve the application subject to conditions and a S106 agreement relating to a) the cleaning of the land up to 50 metres from the premises after closure each day and b) the linking of the proposed private CCTV system to the Council's town centre system on a permanent basis. The Head of Development Control stated that Officers felt the S106 agreement was not necessary and unreasonable and that J D Weatherspoons had confirmed that they were not prepared to enter into it.

Councillors Wagner and S J Williams spoke in accordance with the Council's scheme for public speaking on planning applications.

RESOLVED:

That the decision of the Development Control and Environmental Protection Committee at their meeting held on 5th February 2008 in respect of the change of use from A1 (non food retail) to A4 (drinking establishment) at Unit 26 Pride Hill, Shrewsbury be not amended.

 

15/08   1 NURSERY HOUSE, CORPORATION LANE, SHREWSBURY

Consideration was given to a report of the Planning Services Manager in respect of the erection of a new dwelling at 1 Nursery House, Corporation Lane, Shrewsbury.

Members had visited the site prior to the start of the meeting.

RESOLVED:

That the Committee endorse the Officer's decision to refuse the proposal for the reasons given in paragraph 1.0 of the report in respect of the erection of a new dwelling at 1 Nursery House, Corporation Lane, Shrewsbury.

 

16/08   8 ALFRED STREET, SHREWSBURY

Consideration was given to a report of the Planning Services Manager in respect of the erection of a new conservatory to rear following demolition of existing conservatory and shed at 8 Alfred Street, Shrewsbury.

Members had visited the site prior to the start of the meeting.

RESOLVED:

That the use of UPVC be acceptable in respect of the erection of a new conservatory to rear following demolition of existing conservatory and shed at 8 Alfred Street, Shrewsbury.

 

17/08   17 LANGFORD AVENUE, BAYSTON HILL, SHREWSBURY

Consideration was given to a report of the Planning Services Manager in respect of the erection of a two storey side/rear extension, single storey rear extension and pitched roof over front bay window following demolition of existing garage and conservatory (amendment to previous approved scheme reference 05/1090/F dated 14th September 2005) at 17 Langford Avenue, Bayston Hill, Shrewsbury.

Members had visited the site prior to the start of the meeting.

RESOLVED:

That the revisions shown on drawing no. 8303/1416 03 be accepted as amendments to the original approved application in respect of the erection of a two storey side/rear extension, single storey rear extension and pitched roof over front bay window following demolition of existing garage and conservatory (amendment to previous approved scheme reference 05/1090/F dated 14th September 2005) at 17 Langford Avenue, Bayston Hill, Shrewsbury.

 

18/08   APPLICATIONS FOR DEVELOPMENT

The Planning Services Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Councillor Owen indicated that in relation to Item 13 – Maesbrook Nursing Home, Church Road, Meole Brace, Shrewsbury he had predetermined the application as he supported the residents' objections and objected to the proposals on the grounds of drainage and sewerage problems, increased traffic and over development of the site. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, he made a statement and then left the room and took no part in the consideration of or voting on the application.

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

 

Item 5: 08/0088/F - Land to the rear of Clover Cottage, Ford, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reasons:

The development would be detrimental to the amenity of the dwellings to the south of the site by virtue of the close proximity of the proposed new dwellings to the rear of the existing houses and traffic movement along the proposed private drive adjacent to the site boundary, contrary to Borough Local Plan Policies GP1 and HS3.

The proposal would be unacceptable backland development, poorly related to its surroundings, which would be out of character with the pattern of development in the village contrary to Borough Local Plan Policies GP1 and HS3.

The proposal would lead to an increase in traffic movements from the site onto the narrow public highway, Butt Lane, where there are existing problems with parked vehicles narrowing the passable highway and which would create poor visibility for vehicles emerging from the driveway onto Butt Lane, to the detriment of highway safety, and contrary to Borough Local Plan Policies GP1 and HS3.

 

Item 20: 08/0012/F - Former Railway Land, Sutton Lane, Shrewsbury

The Development Control and Environmental Protection Committee requested that the Head of Development Control advise the applicant that they would like the comments of the Police Architectural Liaison Officer in respect of the access to the narrow footpaths to the rear of 35, 36, 37 and 47 being restricted by the inclusion of lockable gates to be implemented.

 

Item 27: 07/1722/F - New Inn, Hook-a-Gate, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be approved for the following reason:

Z102I…it was considered that the use was an appropriate one for the locality and for a temporary period would not be detrimental to the appearance of the area.

Include the following conditions:

G01; G10I (plan 1:200 received 12th December 2007)

There shall be no more than eight cars for sale located on the site at any one time.

Reason: In order to protect the visual appearance of the area.

No vehicles shall be repaired or serviced on the site.

Reason: Only the display of cars is considered to be appropriate in this location.

No structures of any kind shall be located on the site.

Reason: In order to protect the visual amenity of the locality.

This permission shall only last for three years and at the end of that period, the business shall cease and all vehicles removed from the site.

Reason: It is considered that the site is not appropriate for a permanent permission.

This permission shall be for the benefit of Mr R.H. Hunter and no other person.

Reason: In order to control the operation and to ensure it is appropriately run without detriment to the amenity of the locality.

Within one month of the permission, details of the proposed fencing of the site area shall be submitted for the prior written approval of the Local Planning Authority and the approved details implemented within one month of the written approval.

Reason: In order to provide a visually appropriate method of fencing details.

Include a S106 agreement relating to tying the car sales area to the public house business – not sold off or let as a separate entity.

The Development Control and Environmental Protection Committee determined that the application be approved for the following reason:

19/08   PLANNING APPEALS

Consideration was given to the appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Planning Services Manager:

 

a)  Holderness, David Avenue, Pontesbury, Shrewsbury – Appeal against refusal to grant planning permission for two four bed houses and linked garages following demolition of existing dormer bungalow Ref: 07/0902/O – appeal dismissed 28th January 2008.

 

b)  Sundorne Retail Park, Shrewsbury – Appeal against refusal of advertisement consent for four double sided six sheet poster units, with internal illumination Ref: 07/0772/ADV – appeal dismissed 30th January 2008.

 

c)  Rear of 98-100 Frankwell, Shrewsbury – Appeal against refusal to grant planning permission for 3 three bedroomed properties and associated groundworks Ref: 07/0509/F – appeal allowed 29th January 2008.

 

d)  Land at rear of Four Crosses Inn, Holyhead Road, Bicton, Shrewsbury – Appeal against refusal to grant planning permission for erection of storage and distribution building to include office accommodation and new access Ref: 07/1126/F – appeal dismissed 8th February 2008.

 

e)  Land adjacent to The Villa, Willcott, Nesscliffe, Shrewsbury – Appeal against refusal to grant planning permission for three detached houses, including means of access Ref: 07/0301/O – appeal dismissed 13th February 2008.

 

f)  The Crown Inn, 115 Longden Coleham, Shrewsbury – Appeal against refusal to grant planning permission and Listed Building Consent for erection of single storey all weather eating area Ref: 06/1551/F and 06/1554/F – appeals dismissed 1st February 2008.

 

g)  Heath Cottage Farm, Ford – Appeal against enforcement notice in relation to change of use of agricultural land for siting of touring caravan for residential purposes and use of structure for ancillary residential storage Ref: APP/06/0024/ENF – appeal dismissed and enforcement notice upheld 7th February 2008.

RESOLVED:

That the decisions in respect of the above appeals be noted.

 

20/08   EXEMPT ITEM

RESOLVED:

That under Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining item on the grounds that it could involve the disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 12A of the Act.
