31/08 APPOINTMENT OF CHAIRMAN
RESOLVED:
That Councillor Mrs Williams be appointed Chairman of the Committee for the period until the dissolution of the Council in March 2009.
32/08 APPOINTMENT OF VICE-CHAIRMAN
RESOLVED:
That Councillor Bebb be appointed Vice-Chairman of the Committee for the period until the dissolution of the Council in March 2009.

34/08 FORMER TAYLOR BROS PREMISES, NEW PARK CLOSE, SHREWSBURY
Consideration was given to a report of the Planning Services Manager in respect of the erection of 13 two-storey dwellings and alterations to existing vehicular and pedestrian accesses (amended description) at Former Taylor Bros Premises, New Park Close, Shrewsbury.
The Head of Development Control stated that paragraph 1.1 of the report needed to be amended to read "The purpose of this report is to consider a part retrospective amendment to planning permission ref. 07/1183/F approved under delegated powers in October 2007".
The Committee was also informed that amended plans had been received on 19th May 2008.
RESOLVED:
That the proposed amendments shown on the amended plans received 16th April 2008, 1st May 2008 and 19th May 2008 be approved in respect of the erection of 13 two-storey dwellings and alterations to existing vehicular and pedestrian accesses (amended description) at Former Taylor Bros Premises, New Park Close, Shrewsbury.
35/08 37 HEREFORD ROAD, SHREWSBURY
Consideration was given to a report of the Planning Services Manager in respect of the erection of a single storey side extension and conservatory, together with timber decking over garden store and alterations to form double gated access, erection of detached garage following demolition of existing garage and shed buildings (amendment to previous scheme approved under reference 04/0359/F dated 6th May 2005) at 37 Hereford Road, Shrewsbury.
Members had visited the site prior to the start of the meeting.
RESOLVED:
That the revisions shown on the plans reference SK 10 Rev C, SK 11 Rev C and SK 12 Rev C received 18th April 2008 be accepted as amendments to the approved application in respect of the erection of a single storey side extension and conservatory, together with timber decking over garden store and alterations to form double gated access, erection of detached garage following demolition of existing garage and shed buildings (amendment to previous scheme approved under reference 04/0359/F dated 6th May 2005) at 37 Hereford Road, Shrewsbury.
36/08 CHURCH OF THE HOLY FATHERS, SUTTON, SHREWSBURY
Consideration was given to a report of the Planning Services Manager in respect of the reinstatement of previously removed bellcote affecting a Grade II* listed building at the Church of The Holy Fathers, Sutton, Shrewsbury.
RESOLVED:
That the proposal as detailed in the applicants letter of the 31st March 2008 be accepted in respect of the reinstatement of previously removed bellcote affecting a Grade II* listed building at the Church of The Holy Fathers, Sutton, Shrewsbury.

In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

RESOLVED:
That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 3: 08/0330/F - 5, 6 & 7 St Austins Street, Shrewsbury
Include the following condition:
The security gates at the rear of the premises are not to be set back within the archway.
Reason: In order to prevent a concealed area for nuisance and anti-social behaviour from occurring.
Item 4: 08/0361/VAR - Marysville Medical Practice, Brook Street, Shrewsbury
Include the following amendment:
Add temporary use condition three years for hours 7.00 a.m. to 9.00 p.m.
Item 5: 08/0377/O - Garden of 45 Montague Place, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reasons:
The proposal will result in a cramped site and be overdevelopment with a lack of adequate amenity space and car parking / manoeuvring space and be contrary to Policies GP1 and HS2 of the Shrewsbury and Atcham Borough Local Plan.
The proposal will be detrimental to the character and appearance of this part of the Belle Vue Conservation Area with the loss of side garden space and through the introduction of a detached house and be contrary to Policies HS2 and HE8 of the Shrewsbury and Atcham Borough Local Plan.
The erection of a two storey detached house in close proximity to the two neighbouring dwellings would be overbearing and unneighbourly to the occupiers of those two dwellings with the resultant loss of amenity. Contrary to Policy GP1 of the Shrewsbury and Atcham Borough Local Plan.
38/08 PLANNING APPEALS
Consideration was given to the appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Planning Services Manager.
(a) 23/25 Chester Street, Shrewsbury Appeal against refusal to grant planning permission for erection of three storey building to provide 9 flats, formation of parking areas and erection of covered bin store, following demolition of existing commercial buildings Ref: 06/1579/F appeal dismissed 15th April 2008.
(b) The Pines, Linley Avenue, Pontesbury Appeal against refusal to grant planning permission for erection of 2 no. semi detached dwellings and 4 no. terraced dwelling houses, including 2 no. low cost units, following demolition of existing bungalow and garage Ref: 07/1052/F appeal dismissed 17th April 2008.
(c) 46 Mardol, Shrewsbury Appeal against refusal to grant a variation of condition to allow takeaway to operate with extended opening hours (to midnight Sunday to Thursday and to 03.00 the following morning Friday and Saturday) Ref: 07/1205/VAR appeal dismissed 17th April 2008.
RESOLVED:
That the decisions in respect of the above appeals be noted.
39/08 EXEMPT ITEM
RESOLVED:
That under Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining item on the grounds that it could involve the disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 12A of the Act.
40/08 DEVELOPMENT CONTROL AND ENVIRONMENTAL PROTECTION COMMITTEE MEETING SITE VISITS
(The Chairman indicated that she had agreed that this matter should be considered as a matter of urgency in the interests of the Council).Consideration was given to the points raised by members of the Committee in respect of the Development Control and Environmental Protection Committee meeting site visits.
