04/03 LAND ADJACENT NO.2 THE HAZELS, ANNESCROFT
Consideration was given to a report by the Development Control Manager in respect of a reference from the Development Control and Environmental Protection Committee held on 4th November 2003 in relation to an outline application for the erection of one dwelling to include means of access and siting of building, on land adjacent to No. 2 The Hazels, Annscroft (03/1180/O).
Members of the Development Control and Environmental Protection Committee had recommended that the application be approved, which constituted in a significant departure from the development plan. In accordance with the planning procedure adopted by the Council, The application had been referred to the Planning Committee for determination.
In accordance with the Council’s scheme of public speaking on planning applications Mr Bradney spoke against the application, and the applicant, Mr Jones responded.
The Chairman referred to a schedule of late letters that was circulated at the meeting and informed the Committee that the proposal had been advertised as a departure from the Development Plan.
Members had visited the site.
RESOLVED:
That the application be refused for the following reasons:
(a) In the opinion of the Local Planning Authority the proposed development of this backland plot is contrary to Policy HS4 (iii) of the Borough Local Plan in that the proposal is uncharacteristic of the linear settlement pattern of Annscroft.
(b) A dwelling erected on this part side garden area as proposed would reduce the part side private amenity space of 2 The Hazels to an unacceptable degree and furthermore, by introducing additional domestic activity in this backland site, the existing standards of residential amenity of the occupiers of residential properties adjoining the site would be seriously diminished and is contrary to Policy HS2 of the Borough Local Plan.
(c) The proposal would result in an unneighbourly form of development in that it would lead to noise and disturbance which the Local Planning Authority considers would be detrimental to the amenities which the occupiers of the adjoining properties could reasonably expect to enjoy and is contrary to Policy GP4 of the Borough Local Plan.
Members of the Planning Committee determined that the application be refused contrary to the recommendation from the Development Control and Environmental Protection Committee.
