A New Contaminated Land Regime
Part IIA of the Environmental Protection Act 1990 places a new set of duties on District, Borough and Unitary Authorities to systematically address the issue of contaminated land within their district. These duties exist in addition to those requiring that contaminated sites are cleaned up through compliance with conditions attached to Planning Consents when sites are being redeveloped.
General guidance for the public and to developers carrying out a Contaminated Land Investigation in the context of applying for Planning Approval is set out in the following document.
Contaminated Land is defined in Part IIA of the Environmental Protection Act 1990 as any land which appears to the Local Authority in whose area it is situated, to be in such a condition, by reason of substances in or under the land that:
- Significant harm is being caused, or there is a significant possibility of such harm being caused; or
- Pollution of Controlled Waters is being, or is likely to be caused.
In order for land to be defined as 'contaminated land' there must be a source of contamination, a receptor that can be harmed and a pathway by which the receptor can be exposed to the contamination.
Part IIA of the Environmental Protection Act 1990 requires that Shrewsbury and Atcham Borough Council inspects its area from "time to time" for the purpose of identifying land which may fall within the statutory definition of contaminated land. It is not stipulated at what frequency re-inspection takes place, as many factors will affect this. However, Shrewsbury and Atcham Borough Council will maintain a strategic approach to ensure that limited resources are targeted at areas of greatest need and this is set out in a written strategy.
This strategy will help Shrewsbury and Atcham Borough Council to identify areas of contaminated land and where necessary require remediation to clean up the land to return it to a 'suitable use' and preferably bringing it back into beneficial use.
Shrewsbury and Atcham Borough Council is satisfied that it has taken a strategic approach to the identification of land which merits detailed individual inspection and this has been set out in the following document.
