How do I dispute the Charge?

Instructions and Information

If you intend to challenge the issue of a PCN, do not make/send payment.

Any representation or challenge with regard to the issue of a Penalty Charge Notice must be made in writing and include the following:

  • Full name and postal address.
  • Penalty Charge Notice number must be quoted on all correspondence.
  • Vehicle Registration Mark

Our intention is that an email portal will be available on this site for you to submit a challenge electronically.  This is dependant on SABC IT resources.  Meanwhile, if you would like to submit a challenge by email please do so by including your name, full postal address and Penalty Charge Notice number to parkright@parkright.org.uk

A challenge will be investigated and formally responded to by letter.  All challenges will be responded or acknowledged within 10 working days of receipt.

Appeals Procedure

Stage 1 - Informal Challenge

On receipt of a written challenge we will put the Charge on hold until we respond to you in writing.  We will examine every case individually and if we accept your reasons, we will cancel the Charge and you will not have to pay. Those received within the discount period, i.e. 14 days of the date of issue, will be offered extended discount in the event that the challenge is rejected.

Stage 2 - Formal Representation

If your informal challenge is rejected by ParkRight, a further formal Representation can be made to ParkRight when the registered keeper of the vehicle receives a Notice to Owner (NTO). This will be sent out 28 days after the Penalty Charge is issued, if it remains unpaid.  The full penalty will be payable at this stage. A Notice to Owner is sent at this time irrespective as to whether an informal challenge was initially made, should the PCN remain outstanding.

An Appeals Officer not involved in the earlier informal Challenge Stage, will investigate your formal Representation.

Stage 3 - Appeal

If your formal Representation is rejected by ParkRight, a subsequent Appeal may be made to the Traffic Penalty Tribunal for consideration by independent adjudicators.  This may be dealt with by post, telephone or at a personal hearing. This part of the procedure will be fully explained in our letter to you, when we explain the reasons for upholding the Charge.

The adjudicator's ruling is final and a motorist could face having to pay costs if their Appeal was felt to be unreasonable.  Costs may also be awarded against ParkRight if it is considered to have acted similarly.
